before the event my nephew go in and get "measured", a month later the sunshine of the event he was shifting and noticed that the shirt be torn, pants be too big, vest was 10 sizes smaller and so on... when we returned the tuxedo the we explained the problem to the representative, she was overall rude and we feel disrespected, we didnt even get our deposit posterior. should i contact a lawyer and parley to him about it or basically leave it?

Absolutely sweetheart. When you sign a contract and tell them what you want and they agree to it, they are responsible to gather round the terms of that contract to your specifications.

Anything you receive save for what you specificallly ordered is a breach of contract and you are entitle to recover your losses.
